Subject: Western Dakota Technical Institute Program Enhancements
Drafting and Machining Technology (AAS), HVAC and Plumbing Technology (AAS), Bookkeeping (Diploma), Healthcare Technician (Diploma), Pharmacy Tech (addition of an AAS option)

Background: Western Dakota Technical Institute (WDT) is seeking approval to expand several of their existing diploma programs as follows:
Drafting and Machining Technology (AAS)
HVAC and Plumbing Technology (AAS)
Bookkeeping (Diploma)
Healthcare Technician (Diploma)
Pharmacy Tech (addition of an AAS option)

Recommendation: Recommend approval of program expansions.

Agenda Item 5.0 - Sarah Carter, DOE & Vicki Wiese, Vice President, MTI

Subject: Mitchell Technical Institute
New Human Services Technician Program Request

Background: In March of 2013 Mitchell Technical Institute (MTI) requested approval to begin a Human Services Technician Program. This program will be 18 months in length, resulting in an Associate of Applied Science (AAS) degree. The Human Services Associate Degree program trains people to provide information, support, care and advocacy in a human services agency. MTI has updated their program information based on feedback from the Board of Education and is presenting it for a second read.

Recommendation: Approval for start fall 2013

Subject: Lake Area Technical Institute Land Purchase Request
Amendment
Omnibus Amendment

Background: Lake Area Technical Institute (LATI) is requesting approval for the acquisition of an approximately 96,470 square foot parcel of property adjoining the Lake Area Technical Institute campus for use as a parking lot. LATI is completing the building of a program and technical building. This purchase of this adjoining property is critical for the parking needed for the 300+ students who will be in that new building. LATI is landlocked so purchasing any adjoining property as it becomes available, for a reasonable price, is vital to the continued growth and development of the institute.

Recommendation: Approve the purchase of an approximately 96,470 square foot parcel of property adjoining the Lake Area Technical Institute campus for use as a parking lot.

Background: Sam Gingerich, System Vice President for Academic Affairs for the Board of Regents, will provide an update on a set of university initiatives that link with the work of the Department of Education. This will include presentation of this year’s Regental Teacher Education Accountability Report, an update on the work being done to redesign the system’s teacher education and educational leadership programs, and the work the Regental system is doing with the department to define college readiness as the state prepares for the implementation of the Smarter Balanced assessment.

Subject: Public Hearing for rules changes to adjust the teacher certification fee (ARSD 24:15:03:05)

Background: Based on ongoing expenditures and revenues from the Institute Fund, it is projected that the fund will not be able to support the functions related to teacher certification beginning in FY2016. Because of the provision in SDCL 13-42-4 which states that any changes to teacher certification requirements, including changes to certification fees, require two years’ notice before they go into effect, a change to the rules must be addressed now to go into effect for the FY2016 fiscal year.

Subject: First Reading for rules related to HB 1098

Background: House Bill 1098, passed in the spring of 2013, requires the Legislature to approve bonds for lease purchase agreements with the four postsecondary technical institutes, and to approve bonds for lease purchase agreements with Western Dakota Technical Institute and Southeast Technical Institute. The first draft of the rules will be presented to the Board of Education.

Background: First reading for 24:05 language clean-up. In going through ARSD 24:05, Special Education Programs has come across several items that need updating or correcting.

Subject: First Reading Birth to Three Rules clean-up for ARSD 24:14:13:03

Background: The prior written notice requirements in ARSD 24:14:13:03 refer to the notice being sent "within five working days." To be consistent throughout chapter 24:14 an to align with the Special Education Part B requirement, the term "working" should be removed.

Subject: First Reading Coordinated Early Intervening Rules related to SB 15

Background: Senate Bill 15 charged the Board of Education to promulgate rules to establish an application process, application timeline, criteria for approving a district’s use of special education funds, and the collection of data on children served with this funding.

Subject: First Reading Military Spouse Certification Rules ARSD 24:15

Background: The 2013 Legislature passed a law requiring expedited certification processes for military spouses leaving employment in other states to accompany their spouses for military service in South Dakota. This is a rule to outline the DOE process for handling military spouse certification.

Subject: First Reading – Public School Accountability System clean-up for ARSD 24:55

Background: The Department of Education is proposing certain changes to the accountability system for public schools. As the state has worked through the ESEA Flexibility Waiver process and an initial year of implementation in the state, these changes will clarify the process itself, as well as the supports and assistance offered to schools through this process.

Subject: First Reading to update Onsite Review Process for ARSD 24:43:02:06

Background: Currently, the process to accredit public school districts and non-public schools is done onsite at the district or school undergoing review. The Department of Education is proposing to allow for the state accreditation process to be completed via a desk audit, although onsite visits would continue to occur in certain instances. The desk audit process has been piloted during the 2012-13 school year.
